Money laundering
Allegations of money laundering often arise in connection with complex financial transactions, the origin of assets, and cross-border payment flows.
LENLAW defends individuals and companies in criminal money laundering proceedings and represents victims of economic and property crimes in securing and recovering assets obtained through criminal activity.
Criminal proceedings for money laundering
In cases involving allegations of money laundering under Art. 305bis of the Swiss Criminal Code, questions arise in particular regarding the origin of the assets in question, possible predicate offenses, and the criminal significance of individual transactions.
We analyze payment flows, bank records, and other evidence, and determine whether the objective and subjective elements of the money laundering offense have been met. Based on this, we develop a defense strategy and represent our clients before law enforcement authorities and in court.
Account Freezes and Asset Seizures
Money laundering proceedings are often accompanied by the freezing of bank accounts or the seizure of other assets. We represent affected individuals in requests for the release of funds and appeals, and we review the conditions and scope of asset preservation measures.
International Money Laundering Proceedings
In cross-border financial transactions, evidence, individuals involved, and assets are often located in different countries. In addition, money laundering allegations may be linked to predicate offenses committed abroad and parallel criminal proceedings.
We analyze the international context and take into account its implications for Swiss proceedings. When necessary, we coordinate our approach with foreign legal representatives.
